VidMe ("we," "our," or "us") is committed to providing innovative AI avatar technology while encouraging responsible use. This AI Avatar Policy outlines the rules, guidelines, and ethical considerations for creating and using AI avatars on our platform. This policy applies to all users of VidMe's services and forms part of our Terms of Service.

Definition of AI Avatars

For the purposes of this policy, "AI Avatars" refers to digitally created or manipulated visual representations of human faces or full bodies, generated or modified using artificial intelligence technologies, which may be animated to speak, move, or perform actions within videos created on our platform.

Consent Requirements

Pre-made AI Avatars

VidMe offers a library of pre-made AI avatars that users can utilize in their content creation. These avatars:

  • Are created with explicit consent from the individuals they represent or are entirely synthetic
  • Can be used in accordance with our Terms of Service without additional consent requirements
  • Are subject to specific usage limitations as defined in this policy

Custom AI Avatars

When creating custom AI avatars:

  1. Self-representation: You may create avatars of yourself without restriction
  2. Third-party representation: For creating avatars of other individuals:
    • You must obtain explicit, documented consent from the individual before creating or using an avatar resembling them
    • The consent must clearly specify the permitted uses, duration, and context
    • You must be able to provide proof of this consent upon request
  3. Public figures: Even for public figures, explicit consent is required unless the use qualifies as parody, commentary, or falls under fair use principles

Prohibited Uses

The following uses of AI avatars are strictly prohibited:

  1. Deception and Misrepresentation:

    • Creating avatars that impersonate others without explicit consent
    • Using avatars to create or share false or misleading information
    • Creating content that could reasonably deceive viewers about a person's identity, actions, or statements
  2. Harmful Content:

    • Using avatars to create content that promotes violence, hate speech, harassment, or discrimination
    • Creating sexually explicit, pornographic, or adult-oriented content
    • Using avatars to bully, defame, or harm the reputation of any individual
  3. Political and Sensitive Applications:

    • Using avatars for political campaigning or election influence without clear disclosure
    • Creating content that could influence public opinion on sensitive social issues without clear AI disclosure
    • Manipulating avatars to make political figures appear to say things they did not say
  4. Commercial Restrictions:

    • Using pre-made avatars for commercial endorsements without appropriate licenses
    • Implying endorsement of products or services by an avatar without proper rights
    • Using avatars in advertising that violates applicable regulations

Required Disclosures

All content created using our AI avatars must include clear disclosure of the AI-generated nature of the content:

  1. Visual Disclosure: All videos must include:

    • A visible watermark or label indicating "AI-generated content" or similar wording
    • This disclosure must be clearly visible and not obscured or minimized
  2. Contextual Disclosure: In descriptions or sharing of the content:

    • Clear statements indicating the artificial nature of the avatar(s)
    • Appropriate tags or labels when sharing on third-party platforms
  3. Transparency in Commercial Use:

    • Additional disclosure requirements apply for commercial content
    • Clear distinction between real individuals and AI avatars in marketing materials

Ownership and Intellectual Property

  1. Pre-made Avatars:

    • VidMe retains all intellectual property rights to pre-made avatars provided in our library
    • Users receive a non-exclusive license to use these avatars in accordance with this policy
    • This license does not permit the extraction, reproduction, or use of these avatars outside our platform
  2. Custom Avatars:

    • You retain ownership of custom avatars you create, subject to the underlying rights of individuals depicted
    • You grant VidMe a limited license to process, store, and render videos using these avatars
    • This license does not permit us to use your custom avatars for other purposes without your consent

Content Moderation and Enforcement

We enforce this policy through:

  1. Automated Screening:

    • AI-based detection systems to identify potentially violating content
    • Technical safeguards against known misuse patterns
  2. Human Review:

    • Review of flagged content by our moderation team
    • Assessment of reported violations
  3. Consequences for Violations:

    • Removal of violating content
    • Warnings for first-time or minor violations
    • Account suspension or termination for serious or repeated violations
    • Potential reporting to legal authorities for illegal uses

User Reporting

We encourage users to report violations of this policy:

  • Use the "Report" function within our platform
  • Provide specific details about the potential violation
  • Include URLs, timestamps, or screenshots when possible
